On 12 March 2019, the Spanish government approved the Royal Decree-Law that amends the previous workers' statute and obliges companies to establish a time and attendance system for all their employees.<\/p>\n

The new law thus aims to combat job insecurity and avoid situations that go beyond the law.<\/p>\n

The Royal Decree Law obliges, from 12 May<\/u>, The Commission has also called for all companies, irrespective of the number of employees, to have a record of working hours.<\/p>\n

The new regulation comes into force two months after the publication of Royal Decree-Law 8\/2019, which took place on Tuesday 12 March, meaning that companies will have to start the mandatory registration by 12 May 2019.<\/p>\n

The company must account for all hours worked, both ordinary working hours and overtime worked by each worker.<\/p>\n

The register shall include the exact time of arrival and departure of each worker. Flexible working time may not lead to non-compliance with the rules on the maximum number of hours worked.<\/p>\n

Companies must keep records of the working time worked by their employees for four years. These records must be available both to employees and to the Labour and Safety Inspectorate.<\/p>\n
