On 12 March 2019, the Spanish government approved the Royal Decree-Law that amends the previous workers' statute and obliges companies to establish a time and attendance system for all their employees.

The new law thus aims to combat job insecurity and avoid situations that go beyond the law.

The new regulation comes into force two months after the publication of Royal Decree-Law 8/2019, which took place on Tuesday 12 March, meaning that companies will have to start the mandatory registration by 12 May 2019.

The company must account for all hours worked, both ordinary working hours and overtime worked by each worker.

The register shall include the exact time of arrival and departure of each worker. Flexible working time may not lead to non-compliance with the rules on the maximum number of hours worked.

Companies must keep records of the working time worked by their employees for four years. These records must be available both to employees and to the Labour and Safety Inspectorate.
